Kina: 10 års fengsel for internettbruk

Journalisten Shi Tao sendte i 2004 et internt direktiv fra regjeringen til journalister om dekningen av årsdagen for Tienanmen-massakren, til en amerikanskbasert nettside. Han ble siktet for å ha "ulovlig videreformidlet statshemmeligheter til utenlandske aktører", og dømt til 10 års fengsel.

Forut for arrestasjonen hadde Shi Tao jobbet for magasinet Contemporary Trade News, og utgitt flertallige artikler og politiske kommentarer relatert til de sosiale problemene i Kina.

Samarbeid mellom kinesiske myndigheter og Yahoo! har resultert i arrestasjoner av journalister og strengere internett-sensur. Ifølge rettsdokumentene fra rettssaken, var det blant bevisene som førte til hans domsfellelse bruker-id og informasjon overlevert av Yahoo! Det har nylig blitt kjent at Yahoo! også kan ha gitt videre informasjon som muligens har ført til arrestasjonen av en annen aktivist, Li Zhin. Amnesty International ser med stor bekymring på denne utviklingen av samarbeidet mellom Yahoo! og de kinesiske myndighetene.

Shi samvittighetsfange
Amnesty International anser Shi Tao som en samvittighetsfange, fengslet for å ha benyttet ytringsfriheten på en fredfull måte, og for helt lovlig å ha benyttet seg av sin rett til å søke, motta og dele informasjon, i henhold til internasjonal lov og kinesisk grunnlov.

Amnesty International mener at Shi Tao var ett av mange mål for politirazziaer sent i 2004 og tidlig 2005. I denne perioden ble flere menneskerettighetsaktivister rapportert anholdt eller satt under overvåking i deres hjem. Årsakene til disse arrestasjonene var åpenbart å hindre dem i å engasjere seg i offentlige aktiviteter som myndighetene betrakter som politisk sensitive, som forberedelsene til 15 års-markeringen av Tienanmen-massakren.

It distresses me to hear that Shi Tao is being forced to work under harsh prison conditions and I ask that you guarantee Shi Tao’s safety and well-being in detention, including by granting regular and unrestricted access to his family, lawyer and any medical attention that he may need. I am also deeply concerned to learn that Shi Tao’s family has been subjected to harassment and surveillance, and strongly urge you to ensure that this is immediately stopped. Freedom of expression is a fundamental human right, and all journalists and human rights defenders should be able to carry out their work without the fear of harassment or detention. In light of this, I feel it is necessary that the Chinese criminal law be reviewed and the use of broadly worded and vaguely defined clauses such as “supplying state secrets abroad”, “endangering national security”, and “subverting state power”, which are used to target journalists and human rights defenders, be stopped.
